After my 3 months of marriage I found abnormal behaviour of my wife. She doesnt used to talk much, neither with me nor with my relatives. Then her abnormal acts starts, someday she used to clean washroom midnight 1 , one day I found pencils marks on walls, one day she broke her gold chudda, one day she broke her phone, some of her clothes were torn, but she used to be very innocent that no one can judge. After 6 months of my marriage when she was not talking with me like a married wife I complained her family. And then she went into deep depression. She was just wanted to suicide. I saved her. Took care of her. Got her good treatment. She became normal. Than she confessed that before marriage twice she went to doctor for mental health issue. After telling me truth she went back into depression. Her family took her. After 1 month her family and she appollogies for hidden truth. Then we took her back to our house. She was absolutely fine doing household works. But after 3 days again she went back to depression. And she tried to commit suicide. We saved her. Sent her back to her home. Its been 6 months now. My family can't forget that scene. I want to divorce that girl.. But she is not ready for it. I cant live always in fearful state. Is there any solution for this. Will I get contested divorce on the basis of this.. Her parents claims that she is absolutely fine now but treatment will very long.. But our family cant accept it.. Is there any solution I can get from court. Will court force me to live with her.

In the given situation, you may file a case for divorce before the Court, but it may be difficult for you to prove your wife is mentally challenged and unable to discharge the basic duties and obligations involved in matrimonial as well as conjugal relationships especially when she does not agree for divorce and also in absence of any medical report declaring her a mentally challenged patient.
