I have elder brother,elder sister ,My father had earned with his hardwork two buildings and a land , these all are in his name and he died without writing his will, my mother influenced by my brother and sister is refusing to pay equal share of rents coming on the property , both my brother and sister are quarrelling with me and my wife ,they once beaten us when we asked about share in the property and police complaint is filed from that day my mother and brother and sister refusing to pay any rents and they are forcing us to leave the property, I want relief fromthis constant quarrelling, how can I get equal share of property and rent without approval of my mother because my mother also supporting my brother and sister and deserting me, and is my mother have rights to write all property to my brother and sister excluding me, how can I get equal share

A.Dear Client,

In case of Self-acquired property left by the owner intestate, the property is equally shared by the surviving legal heirs and members of the family of the deceased. So, you got every right to claim an equal share in the property and an equal share in the income generated from that property. First, you try to obtain a certified copy of the Deed of all intestate properties of your father either from the Registration office, Block Land reform office or CO. and get in touch with an Advocate with all this information for guidance and taking appropriate steps in the matter.
