In 2011, My father who is the owner of the property, and I being his elder son signed the Family settlement deed and got it executed in the registration department to my younger brother as I was going thru a divorce and fear of losing the property. the divorce case is closed. My father expired last year. Can I claim my share in the property now? Please suggest.

A.Dear Client,

In the case of self-acquired property of your father when you transferred your share in f/o your younger brother through a registered family settlement with the consent of your father who is also a signatory of that family settlement, you now cannot claim back your share in the self-acquired property of your deceased father which you transferred to your younger brother through a registered deed of family settlement.
