Absolute sale deed for a City Improvement trust board (CITB) auction corner site Absolute sale deed for a City Improvement trust board (CITB) auction corner site

My Late father purchased a corner plot in 1972 in Jayanagar, Bengaluru, from an owner, who in turn had purchased the site from a successful bidder of a CITB auction winner, who was provided a Possession Certificate(PC) by CITB. This PC was endorsed by CITB on to the second buyer. The property has remained with my late father ever since and he made a development agreement with 4 others in 1994 and constructed flats per the BDA planning cell plan approval. Katha's as applicable have been obtained appropriately from the corporation / BBMP. Taxes as applicable have been paid till date. However an Absolute sale deed was never obtained from CITB / BDA by any of the owners.
My query is a) Can we get an absolute sale deed today? b) Who has to apply for the absolute sale deed the legal heirs of my late father or the legal heirs + development agreement participants who have undivided land share as per individual flat sale agreements. c) What is the procedure and cost involved in this activity.

A.Dear client,

a) Obtaining an absolute sale deed: Typically, the absolute sale deed is issued by the relevant authority, such as the Bangalore Development Authority (BDA) or the local municipality. To obtain the deed, you would need to follow the legal procedures prescribed by the authorities and provide the necessary documentation.

b) Applicants for the absolute sale deed: The legal heirs of your late father would generally have the primary right to apply for the absolute sale deed. However, the participants in the development agreement who have undivided land share may also have a claim to apply for the deed. It's advisable to consult with a lawyer to determine the best course of action based on the specific circumstances and legal requirements.

c) Procedure and cost: The procedure and cost involved in obtaining an absolute sale deed can vary depending on factors such as the jurisdiction, the specific property, and the applicable laws and regulations. The lawyer or legal professional you consult will be able to guide you through the procedure and provide an estimate of the costs involved.
