My grandfather had 10 acre agricultural ancestoral land. He had two heirs one son (my father) and one daughter (my bhua). After Death of my Father my grandfather gave 5 acres of his land to his daughter (my bhua). Now my grandfather is dead (without any will), my grandmother is dead (without any will) my father already dead , my bhua is alive. Now According to punjab ancestoral Sikh property law what is my share in ancestoral property ?

A.Dear client,
If the property is deemed ancestral property under the Hindu Succession Act, then your grandfather's part would have been evenly divided between his two legal successors, who are your father and your aunt (bhua), upon his passing. However, because your grandfather gave your aunt 5 acres of his land during his lifetime, that area is no longer regarded as ancestral territory. You two will each receive an equal share of the remaining portion.

A.Hi client,

As of my knowledge there is no specific Ancestral Law of properties for the Sikh , Punjabi people.The property laws applicable to Sikhs are generally governed by the same laws that apply to Hindus, such as the Hindu Succession Act, 1956, and the Indian Succession Act, 1925.
Under the Hindu Succession Act, if the property is considered ancestral property, then upon the death of your grandfather, his share would have been equally divided between his two legal heirs, which are your father and your aunt (bhua). However, since your grandfather gifted 5 acres of his land to your aunt during his lifetime, that portion would no longer be considered ancestral property. The rest share will be equally divided between you two.
