There are several quarrel between me and my wife. Starting with her abusive language, her abuse to my parents and relatives, her chatting, flirting and affairs with different guys online(but no physical relationship), she and her parents sold off the gold(meher that I have her) without my consent and I was paying it's zakat(muslim traditional amout to give in alms to poor for 4 years), she abusing our child alsoand started slapping her when she was just a year old because she would not eat food, and I have all this proof as audio, we also sat with their family to discuss once which is also under audio record( she admitting her wrongs) ,Our marriage was based as per Muslim law. We have a 1.5 year old daughter. After all this I had to move to another city for job and I got this chance to stay away for a while. But then I thought of being my family to the city and when I return home to do packing I again saw some online chats on her mobile. So I immediately left house and she is under pressure now... Even I informed her parents and they also told her they are not going to support her any further. Now I told her that there is nothing as trust or word of mouth between her and me... And I am okay to bring her with me to city only under condition that she signs a legal document. My question now is what is that legal document I should get her sign so that in case she again starts things again it's easier for me to get rid of her. About child custody is a later thing as I have 100% sure that once my child is 6-7 years she herself will go and complain about her moms abuse to police. Right now I only want to know any document or action that I can take or make her sign an agreement so that I can get rid of her if things are repeated again. Or atleast I can legally send her back to our home town to live Seperatly(rented house there which I will pay her expense monthly) . Please advise.
you can file a petition for judicial separation. Judicial separation is a legal process in India by which spouses who are unable to live together because of their incompatibility or irreconcilable differences can be legally separated.
