Domestic - NBW executed but not giving maintenance Domestic - NBW executed but not giving maintenance

After rigorous efforts and years of follow through, we were able to execute the NBW and got the ex husband arrested for not paying dues on maintenance. But I still struggle to get maintenance. Please advise on how to recover. He is rich, has property but deliberately holding off to make me suffer. Please advise.

A.Dear client,

First and foremost, continue working closely with your family law attorney. They will be your best ally in navigating the legal system and finding the most effective ways to recover the maintenance amount. They can help you explore all available legal options and represent you in court.

You may want to consider seeking court enforcement of the maintenance order. If your ex-husband is deliberately not complying, this might be necessary to compel him to pay. The court has the authority to impose penalties or take other measures to ensure compliance with the maintenance order.

Given that your ex-husband is wealthy and owns property, exploring the option of attaching his properties is worth considering. This means that the court can order the sale of his properties to recover the maintenance dues owed to you.

Bank account seizure is another avenue to pursue. If your ex-husband has money in the bank, the court can authorize the seizure of his bank accounts to satisfy the maintenance debt.
In some cases, the court can issue an income execution order, which deducts a portion of your ex-husband's income directly to pay you the maintenance amount. This could be particularly effective if he has a regular job.

Despite the legal battle, it might still be worth attempting negotiation or mediation with your ex-husband (with the assistance of your lawyer). It could lead to a resolution and an agreement for regular maintenance payments, which might be a more sustainable solution in the long run.
Additionally, check if there are NGOs or government agencies that can provide support and legal assistance to women facing such issues. They might be able to offer guidance and resources to help you in this situation.
