My brother wife is widow with compassion i give my house to live with his two sons my father given me empty land to construct house but after i vacate the house she captured my 50yards blocked my road my decided to give me my house return to me and he registered me 250yards 15×150 she too have the same in my registered land my house she is living local SI said v can't vacate her better to go court v went she didn't have any documents accept some notary which my father singed without telling me, i got registered for 250yards now she is not vacating house,all the time police calling us make us fear makes us to sit in police station my father is 72years iam 52years what shall we do sir all police men station talks with her so nicely but with me and my father harsseley they are speaking please reply what case v put for my abusing by my brother wife widow my father is retired railway employee .

In the given situation, to protect your older father from harassment and humiliation from your brother's wife or family, reach out to the office of SDM or DM of the concerned Sub-Division or District to file an application before the Maintenance Tribunal presided over by the SDM/DM u/s.5 of Maintenance and Welfare of Parents and Sr. Citizens Act, 2007 and rules made thereunder explaining therein the nature and details of harassment and humiliation facing by your father in the hand of your brother's wife and his family. This benevolent act is exclusively enacted for the protection of the safety and security of Sr.Citizens who are being harassed and abused by their children at their sunset years to lead a life with dignity and peace. No Advocate is allowed in the proceedings to represent the case either on behalf of Sr. Citizens or OP, erring children/family. Moreover, if any Sr. Citizen is unable to represent his or her grievance, there are Social Service Officer to assist the Sr. Citizen to represent the case suitably before the Maintenance Tribunal who after hearing both the party pass an order of maintenance for a sum upto Rs.10,000/-pm including order of eviction of erring children/family from the property belongs to Sr. Citizens/Parents. This forum is less expensive and hassle-free to resolve disputes. Hope your older father will get justice before this forum.
