I am one of the co- sharer of my ancestral undivided property.Now my cousin have sold a portion to another .
Now how can I protect me from the outsider
A.Dear Client,
A coparcener or legal heir of an ancestral property cannot sell a portion of the property, especially in the case of an undivided property without the consent of another coparcener or legal heirs. Share of coparceners in an ancestral property is sought by filing a partition suit in the Civil Court and on the basis of an order of partition, the property is distributed in an equal share among the coparceners through a deed of partition. In the absence of an order of partition and deed of partition, a coparcener cannot even dispose of any part or portion of the property without the consent of other coparceners. You can file a suit for Declaration and Permanent Injunction against him for declaring owner and to restrained him from selling the property . If you have evidence for funding to buy this property, you file a suit for injunction and possession.
