Gift Deed Gift Deed

I received a part of my grandmother's house from my mother through a gift deed? (her will). I was supposed to be the legal heir upon her death, if that precedes mine. Now, I am leaving for abroad and I do not know might happen and if things can be changed. Is there anything I should do to secure my property or once the property has been transferred to me through a will there is no need to accept or register it?

A.Dear Client,
Will and Gift Deed Distinction: A will and a gift deed are two different legal instruments. A will takes effect after the person's death, while a gift deed transfers ownership during the donor's lifetime. If your grandmother intended to transfer her property to you through a gift deed, this would typically need to be done while she was alive and the transfer would be complete once the deed is registered.

Acceptance and Registration: In the case of a gift deed, you would generally need to accept the gift and the deed would need to be registered as per the provisions of the Registration Act. Once the gift deed is properly executed and registered, the ownership of the property will legally transfer to you.

Inherited Share and Legal Heir: If you intended to inherit a share of your grandmother's house through her will, this would take effect upon her death. The process of inheriting through a will involves legal procedures to establish your claim as a beneficiary and to transfer the property according to the terms of the will.

Securing Property Before Going Abroad: This might involve ensuring that the gift deed is properly executed and registered if it hasn't been already, or initiating the necessary legal procedures to establish your inheritance rights if your grandmother's will is involved.

A.Dear Sir,
If property is given to you through gift deed then immediately transfer it in your name and take some loan on that property so that nobody can touch that property. If property is received through Will then it is very difficult to you to get such property later.
