My Parents adopted my elder brother (Krishna Kumar Bonthu) at his age of around 3 months as they were not blessed with children by that time. After 5 Years of adoption, I (Durga Prasad Bonthu) was born. When my brother was in 10th Standard, he came to know from other sources that he was adopted and he started to show his nastiness on my mother. My father (Gurumurthy Bonthu - Late) used to calm him by giving more money than he asked. He completely spent his young hood staying in room near to the colleges, with nasty reasons. From then till now (Around 19 Years Completed), my mother (Varalakshmi Bonthu) has no peace of mind because of him. My father expired on 22nd June 2015 and from then the Harassment / Atrocities reached its peak.
My Brother (we belong to backward Class) married a Scheduled Caste Girl in 2009, just informing the parents, for which they didn’t attended as did not agreed at that time. [The reason why I was forced to mention the Caste will be understood once the complete problem is read].
Now the bottom line is my adopted elder brother (Krishna Kumar Bonthu) and his wife (Rajyakshmi Bonthu – Government School Teacher, working as a PT in Kolanka Village near Yanam) keep on Harassing my mother (Varalakshmi Bonthu), my wife (Vijaya Durga Bonthu) and me with abuse words by which we all are mentally becoming ill day by day. The only property my father hard earned was a House in 300 Sq Yards Land in Kakinada, on which my brother as a legal hire is absolutely eligible for share in the property.
In addition of asking for his eligible share in the Property, my brother is also asking us to repay the amount that he spent / gave to our father when he was alive and more of it harassing my mother, my wife and me with abuse words is highly unethical and non-judicial and making our life hell. Moreover, taking the advantage of the Scheduled Laws, he is threatening us that if his wife sues a case on us in the court saying that my mother scolded her wife on the name of the Scheduled Caste, then we will be put behind the bars.
Our Property was on my Father’s Name and there was no will. Hence my mother, brother and I are equally eligible for the share. After my father’s expiry, my brother took the possession of the Property Documents. Now holding the Property Documents and harassing us.
Please let us know, how we need to proceed further with this....to have equal property Share to My Mother, My Brother and me.
