My uncle was died. He is unmarried. He is born with 2 brothers and 2 sisters. He built one house. But the house was not in his name. The house was in his mother name. But he only built the house. And he said the youngest sister is my mom. She is divorced. So she only stayed and caring the unmarried brother. So he is said the house is for the younger sister only. But he is not registered the younger sister name in the house. So the other brothers thinked and this is the chance to get a house from mother. What can I do?
A.Dear client,
If the house belongs to your mother's name, your uncle has no right to decide who gets the property irrespective of the fact that he has constructed a house on the plot. Your uncle cannot impose his opinion on your family

A.Dear Client,
When the property is in the name of the mother she alone can dispose of the property irrespective of who built up the building. and in case the owner of the property passes away intestate (without any will or gift), then all the surviving legal heirs are entitled to an equal share in the property and can acquire their individual share in the property through a partition suit or through a deed of family settlement duly registered under Registration Act.
