Hello,

I am one of the three tenants in our Bangalore property. Currently, our monthly rent totals Rs. 52,000, and this amount is divided unevenly among us, with one tenant collecting rent from the others and paying the full amount. The larger room with a balcony and attached bathroom costs Rs. 22,000, while the other two tenants pay Rs. 17,000 and Rs. 18,000 for their smaller rooms.

Recently, one of the flatmates who was paying Rs. 22,000 has vacated the property, and we have a new tenant in their place. Unfortunately, this new tenant is hesitant to pay the Rs. 22,000 rent, claiming it's too high, and has even refused to pay the renewed rent from January 2024. Given this situation, we no longer wish to share the property with this new tenant.

We are seeking guidance on the appropriate steps to take. It's important to note that the new tenant has signed the legal rental agreement. The verbal agreement among the three of us regarding the rent division was mutually agreed upon but not documented in the agreement. The agreement only specifies the total rent of Rs. 52,000.

Please provide advice on the best course of action in this situation.

A.Dear Client,
If all three tenants are the signatories/parties of the earlier rent agreement and also the signatories of the revised rent agreement which was made on entry of the new tenant, then for disagreement and difference arising out of the internal arrangement for sharing of rent between the tenants having no written documents, either all the three or any one or two, can serve a notice to the Building Owner for termination of rent agreement in terms of the rent agreement. Once a notice for termination of rent agreement is served, that may put the new tenant to review or reconsider his decision regarding the internal arrangement of sharing the rent amount. Otherwise, you all have to arrange for relocation for peaceful existence.

A.Dear client,
If the tenant refuses to pay the rent even after the period of 15 days has elapsed, then you can start proceedings against the tenant in the rent control court or in the civil court as the case may be.
