Hi Sir/Madam, Please help me on below.

Our family owns a piece of agricultural land in Andhra Pradesh. Originally, an agreement was made among my grandfather and his three sons, clearly stating that the land belongs equally to all three of them. However, two of the sons have since passed away, leaving only one surviving son. The first son, who is no longer with us, had registered the land solely in his name, and it has now been transferred to his own son. We are now seeking guidance on how to enforce the original agreement to ensure that the land is fairly distributed among all three sons. What is the proper procedure for achieving this?

A.Dear Client,
If the agreement executed between the grandfather and his three sons is a registered deed of family settlement, then you can file a suit for partition of the property in terms of the said deed of family settlement before the Civil Court to get an equal share in the said property. The Limitation Act governs the period of limitation for filing a partition suit and accordingly, the time limit for filing a partition suit is 12 years from the date when the right to sue accrued.
