I got married in June 2018 and now my wife is wanting divorce from me since she is bored from this marriage. She is saying she never wanted this marriage and she expected I will be rich and established and I am not. She is done with this marriage. She went to her father's house after an argument regarding my financial condition (they are very rich and I am a low middle class person). Now, they are pressuring me for to give her divorce. I don't want to give her divorce. What are my options? Also, is it possible to ask for money from them (out of court) in order to give her divorce? Also, I would like to add my wife is not an Indian National. She is a Bangladeshi citizen and she applied for her indian citizenship based on our marriage. In the meantime, she procured fake AADHAR, PAN and VOTER ID card using which she is working in India. Can we use this against them as a bargaining chip? Her parents are also Bangladeshi Illegal Immigrants.

A.Dear Client,
Irrespective of the facts that have been stated by you in the query, your wife is your wife and shall remain your wife unless you give her a divorce legally either mutually or in contest. The court is the only authority to grant divorce. You may proceed to settle the dispute through family mediation. other party will put certain conditions, if u agree, then you can proceed before the court for mutual consent divorce. or else you have to contest the matter by filing a separate petition. The law provides that out-of-court settlement can be done through the Alternative Dispute Mechanism. The new tools of the justice dispensing system are Mediation, Conciliation, and Lok Adalat. The best way to record an out-of-court settlement is to enter into an agreement that is binding on both parties detailing the terms of the settlement. If your case goes to trial, your divorce decree will indicate the terms of the judge's decision and will act as a judgment that both parties must obey. If you didn't go to trial but settled your case instead, the Court after assessing the fairness of the terms of the settlement, shall pass a decree of divorce accordingly which will contain the terms of the settlement biding upon both the parties.
