When my grandmother came to our Village it was not formed yet, there was a small room which was offered to her by a local who stayed there since she has her kids, it was 70 years ago, we stayed there and village was formed not long after our grandmother moved in there, and all our family members stayed there and still staying there in that house, but we have no patta for that place when we tried to get one, the local some cast people are saying that the house is satram and does not allow us to get patta, but when my grandmother moved it is just a room now we have constructed whole house expanding that room and everything around it. We just want to get patta so the people who are trying to destroy that house won't be able to do so, please advise thanks

A.Dear Sir,
You may file a suit for declaration on the basis of adverse possession for more than 12 years. Thus, there are chances of getting title declared in your favour.

A.Dear Client, According to the legal definition of adverse possession, a person who has lived on a piece of land without a title for 12 years with the owner's consent could be able to claim ownership of the land in question. An individual can claim adverse possession over others' land. This happens when they openly and continously possess that land without any interruption from the land owner for a minimum period of 12 years. The possessor must prove the following in front of the court: The date of possession. The possession was known to the public. The nature of the possession. The continuity of the possession. The duration of the possession. These are the important requirements to prove adverse possession. As per Sec.27 of the Act, if a person fails to file suit for recovery of possession, within a period of limitation, his right to recover the possession of that property is also extinguished. So once you obtan the ownership of the said property on the ground of adverse possession you may apply for patta of the land from the concerned authority. In the prevailing situation, you need to consult with an Advocate to explore suitable remedies and steps to be taken for appropriate relief.
