My father has passed 3 years ago and my grandfather has also passed this year my grandfather has 4 son and his wife is alive my father family include me, my mother, my sister and my brother how the property will distributed among us??
Will the share of my father will also be divided among me , my mother and my siblings?

A.Dear Client,
Irrespective of the class of property whether it is self-acquired or ancestral, if the deceased owner left the property intestate, i.e, without a Will, then all the surviving legal heirs of the deceased owner are entitled to an equal share in the said property. Your father's share in your grandfather's property shall be devolved upon his legal heirs i.e, you, your mother and your siblings in equal share. On receipt of a legal heir certificate from the competent authority, Municipal Corporation/ Tehashildar, a civil suit for partition is required to be filed by any one or all the legal heirs in the Court to acquire individual shares in the property.
