Sir, my father died in 2021. Property tax name has been changed from my father name to mother's name without my knowledge. Is that possible. Please help me out

A.Dear client,

The process of change in name in property tax is not complicated. You would need the following documents, receipt for the most recent property taxes paid, a certified copy of the selling transaction deed from the housing society in your name, NOC, a completed application with your signature attached. The application must be submitted to the Commissioner of Revenue together with the necessary documentation. Within 15 to 30 days of the application and supporting documentation being received and approved, the modification will be reflected in the records. You would also need a death certificate, legal heir certificate, a succession certificate and probate certificate.

A.Dear Client,
On the demise of a property owner any one or all of his surviving legal heirs has to obtain a legal heir certificate from the Municipal Corporation under whose jurisdiction the property is situated and for obtaining a legal heir certificate, an affidavit is required to be sworn before the Ist Class Judicial Magistrate by any one of the surviving legal heirs declaring therein the name, age, address and the relationship of all the legal heirs with the deceased owner in descending order. On receipt of said Affidavit, the widow of the deceased owner who is a senior most legal heir applies for a change of owner's name in the property record for levy of property tax along with the Death Certificate of the Deceased owner, Affidavit and the identity particulars of all the surviving legal heirs and after verification of all the documents, the application of legal heir is processed for mutation or change of the name of the property owner in the record of Municipal Corporation and Property Tax Invoice is generated in the name of the new owner. In the process of changing of owner's name for property tax, the authority is not required to inform all the legal heirs of the deceased owners once a legal heir out of all the legal heirs swears an affidavit before an oath Commissioner declaring the name of all the surviving legal heirs of the deceased owner.
