A.Dear Client,

The rooftops of a building, also known as open terraces, are considered part of the common area and are meant for the use of all floor owners in a multi-storied building. Legally, a builder cannot sell or utilize the terrace for personal gains in a multi-storied building, as it is designated as common space for all floor owners.

In the given situation, you and other flat owners can consider serving a legal notice to the builder, expressing your concerns and objections. Additionally, a collective approach can be taken by filing a mass complaint to the competent authority, which could be the Municipal authority or the Registrar of the Cooperative Societies. This step aims to address the issue amicably and seek resolution through proper channels. It is advisable to consult with legal professionals to ensure the proper procedure is followed and that your rights as owners are protected.
