My grandmother got demiced recently. Grandfather still alive. They have four sons and four daughters. My father is elder son among all.

My grandmother owned some property (land, house, jewelry etc). Land (5.5 acre), she has transferred to one of the sons without consulting any of her son/daughter. Remaing property was still on her name before her demise. I want your advise for the following My doubts.

1. Can my father as the eldest son claim that 5.5 acre land.
2. Some property was not transferred before her demise, who will be owner of that property.

In response to Question 1, if the 5.5-acre land is your grandmother's self-acquired property, your father, as the eldest son, cannot claim it unless specified in her will or through a legal transfer during her lifetime.

Regarding Question 2, if the property was not transferred before your grandmother's demise and she did not leave a will, the ownership of the property would be subject to the Hindu law of succession. In this case, all surviving legal heirs or family members are entitled to an equal share in the property. The distribution would depend on the specific provisions of Hindu succession laws applicable to the situation.

As regards, Q. No.1), Can my father as the eldest son claim that 5.5-acre land, Ans- If the property is the self-acquired property of your grandmother, she can transfer its title to anybody as per her wishes that requires no consent from other family members. As regards, Q. No.2) Some property was not transferred before her demise, who will be owner of that property. Ans- If your grandmother left that property intestate, i.e, without any will, then all the surviving legal heirs/ family members are entitled to an equal share in the said property following the Hindu law of succession.
