Can I buy a slum which is not demolished yet but the survey has been completed for that particular area and the current resident is eligible to get the SRA flat. The owner wants to sell is slum even though he knows he will be getting SRA flat after 3 to 4 years but still wants to sell it due to financial crisis. Please note the owner name is registered under Annexure 2 of SRA.

When land is surveyed by SEA authorities and the owner's name is recorded in Annexure - 2, it is crucial to note that without obtaining consent or a No Objection Certificate (NOC) from the Authority, the owner is prohibited from selling the SEA plot to any third party. Additionally, if a property is built on SRA land, there is a lock-in period of 10 years during which the ownership or title transfer by sale or gift is restricted. The owner of the property cannot transfer its title without the consent or NOC from the relevant authority.

Even after the expiration of the lock-in period, the property owner is still required to obtain permission or NOC from the authority for any title transfer. Therefore, when dealing with SRA land, it is essential to verify and clarify the matter directly with the office of the SRA. It is advisable to take appropriate steps and ensure compliance with the regulations before proceeding with any transactions related to SRA land.

A.Dear Sir,
You are purchasing not only the property but also the litigation. It seems the said property is not free from the litigation. It is better to avoid to purchase such properties.

A.Dear Client,
When land is surveyed by the SEA authorities and the owner's name is recorded in Annexure - 2, until and unless consent or NOC is obtained from the Authority, the owner cannot sell the SEA plot to any third party. A property built up in SRA land has a lock-in period of 10 years to transfer its ownership/title by way of sale or Gift. If the building is constructed on SRA land, then the owner of the property can not transfer its title without the consent/NOC of the concerned authority. Even after the cessation of the lock-in period, he is required to get permission/NOC from the authority. So before buying SRA land, you need to verify/clarify the matter from the office of SRA and take steps accordingly.
