A.Dear Client,

If the space or place designated for parking is not explicitly indicated in the approved building plan, the builder may not legally sell it as a parking lot. To address this issue, you can take the following steps:

1. Serve a Legal Notice to the Builder:
Begin by serving a legal notice to the builder, highlighting the discrepancy in selling a parking space that is not specified in the approved building plan. Clearly state your concerns and demand a resolution to the matter.

2. Approach the Building Plan Approving Authority:
Take the matter up with the building plan approving authority. Provide them with details of the situation and seek their intervention to ensure that the builder adheres to the approved plan. This may involve investigating the legitimacy of the sold parking space.

3. RERA Complaint (if applicable):
If the housing complex is a registered project under the Real Estate (Regulation and Development) Act (RERA), you can bring the matter to the notice of the RERA authority. File a complaint, providing evidence of the discrepancy and seeking their intervention to resolve the issue.

By following these steps, you can seek legal avenues to address the improper sale of parking spaces by the builder. It's crucial to engage with the relevant authorities to ensure that the builder complies with the approved building plan and resolves the issue appropriately.

A.Dear Client,
A space/place other than the car parking place and if it is not shown in the approved building plan, the Builder cannot sell it as a parking lot. Serving a legal notice to the Builder, you may take up the matter with the Building Plan approving authority, for a resolution in the matter. Further, in case the housing complex is a registered project under RERA, you may bring the matter to the notice of the authority to resolve the issue.
