I was alloted a flat under Haryana Affordable housing policy in 2019, in Gurugram..I've been paying regular installment as per demand raised by builder and so far 87.5% has been paid and last installment of 12.5% is pending, now builder is asking to sign an affidavit before providing the details of final amount, project is under construction and in last development stage.
The affidavit says, I or my spouse should no have any land/flat in Gurugram, Chandigarh, Delhi NCR, else my unit will.be forfeited...Is there any such provision ? I have read the Affordable policy 2013 and all the amendments thereafter but no such clause found, only it's stated that while unit allotment preference will be given to those who do not have any plot/flat in these locations but my unit was already alloted to me in 2019..Pls suggest

A.Dear Client,

As per notification no PF-27/48921 dated 19th Aug 2013 issued under the Government of Haryana Affordable Housing Policy, 2013, buyers applying for the allotment of a flat/apartment are obligated to submit a duly notarized affidavit on a Rs.10/- stamp paper. This affidavit, a prerequisite for making the provisional allotment permanent, declares that the buyer's spouse and dependent children do not own an apartment/plot in any HUDA developed colony/sector or any licensed colony in urban areas of Haryana, UT of Chandigarh, and NCT Delhi. This statutory requirement is essential for the buyer, even if the apartment was allotted in 2019, and should ideally be fulfilled before the registration of a deed of conveyance in favor of the purchaser/buyer.

A.Dear Client,
Vide notification no PF-27/48921 dated 19th Aug 2013 issued under the Government of Haryana Affordable Housing Policy, 2013, an affidavit duly notarized on a stamp paper valued Rs.10/- is required to be submitted by the Buyer while applying for allotment of a flat/apartment under Haryana Affordable Housing Policy, 2013 declaring therein that his or her spouse and his dependent children do not own an apartment/ Plot in any HUDA developed colony/ Sector or any licensed colony in any of the urban areas in Haryana, UT of Chandigarh and NCT Delhi. This affidavit is mandatorily required from the buyer to make the provisional allotment a permanent allotment to the buyer preferably before registration of a deed of conveyance in favour of the purchaser/buyer. So, even if you were allotted an apartment in 2019, you need to abide by the statutory requirements required under the Policy.
