In sale deed open shaded car parking but after completion of apartment builder has given covered car parking allotment letter with sign and seal. Is it legal ?

A.Dear Client,

If a builder provides covered car parking instead of the open-shaded parking promised in the sale deed without additional cost to the owner, it's preferable. However, any deviation from the agreement makes the builder accountable for the deficiency. If aggrieved, one can escalate the complaint to RERA or the Consumer Forum for appropriate relief.

An open-shaded car parking is a structure designed to provide protection and shade for vehicles parked beneath it. It is typically a roofed structure with open sides, allowing easy access to the parked vehicle. Covered parking, on the other hand, provides shelter to vehicles and is usually located under a structure like a canopy, stilt, or basement, protecting them from weather conditions such as rain, sun, and snow. If the builder has provided covered car parking instead of open-shaded car parking contrary to what has been stated in the sale deed and if it does not incur any extra cost to the owner, then the covered car parking is the preferred option over open-shaded parking. But for the deviation in the terms of the agreement or sale deed, the Builder is accountable for that deficiency. If you are aggrieved with the action of the Builder, you can escalate your grievance/complaint either before the RERA or the Consumer Forum for the appropriate relief.
