My opponent filed case as RSA in highcourt after expiry of limitation period may be through condonation of delay after 5 months of previous judgement.
1)Is this point is important for to dismiss his case? if so how can fight to get my opponent's case dismissed?
2) Otherwise highcourt itself raise question about this and dismisses his case or highcourt admits his case for hearing?
3) Can I get petition copy online from HC of karnataka before admission of case?

A.Dear client, if the court condones the delay after expiration of limitation period, then it is to be taken that the court will hear the case again based on the merits of the case.

A.If there is delay then the first thing the petitioner will have to do is to get the delay condoned and many a times on valid grounds the court shall do that.
You need to fight the case on the basis of merit of the case and when the case is being heard the court shall ask the appellant to serve a copy of the same to you.

A.Dear sir
You cannot get copy online which is very difficult however you can any advocate and appear before Court and see that it is dismissed on the ground of delay.

A.Dear Client,
The Court allows an appeal or petition filed for condonation of delay based strictly on the merit of the appeal and the reason behind it and the merit in the objection of the other party in the dispute. You can obtain a certified copy(CC) of the petition from the Concerned court in offline mode if you are a party to the case. You have to fill up an application form for the issue of CC and pay the required fees. Sometimes, it involves certain procedures to follow like checking with the concerned court officials, whether the petition has gone to the copying department or not, and at that time you might need the help of a law clerk of the Court. You can also avail of the service of an Advocate if required.
