i went to a night club last year with some friends, they clicked our photos. recently i came to know that they uploaded them on their Facebook page. i contacted the club to get them deleted as i dont want my photos to be available on internet and open to all on a public page. initially the club manager told me that they will delete them. but then he kept saying he will do it tomorrow. now he is not answering my calls ignoring my messages. he picks when i call from any new number says the same thing and then start ignoring that number also. please suggest what to do. i want those photos deleted.

If the club has posted your photo without taking your consent then you have all the rights to ask him to delete or remove the photos from the public domain as that would certainly mean that your privacy has been invaded.
In case the club is not listening to you then send them a legal notice through a lawyer to get the photos removed.

Although taking a photo of you in a public place is not an invasion of privacy, even, it is not always illegal if someone’s photograph is posted on Facebook/social media without his/her consent, it becomes illegal when it is used inappropriately and not deleted from social media even after request. The person should always be concerned about their privacy and take legal action when privacy is infringed. Section 66E of the Information Technology Act, 2000 deals with the transmission of photos of “any person’s private area without his or her consent.” For the same, the penalty is either three years in prison or a fine of not more than two lakh rupees, or both. You can report the matter online to the Cyber Crime Cells which are present in all major cities in India, and have global jurisdiction under the Information Technology Act. To file an online cybercrime complaint, go to this website- http://www.cybercelldelhi.in/Report.html. If required, reach out to an Advocate or cyber crime expert for guidance and steps.

A.Dear Client,
You can send a legal notice to the club authority to remove the photos from their facebook page. If they refuse, you can file a cyber complaint against them online on National Cyber Crime Reporting Portal (NCCRP) or file a written complaint to your nearest cyber cell. The investigation team will enquire into the matter and help remove the photos.
