If person's belongs to RBA but not avails the same certificate due to non-eligibilty then in this case am I eligible for EWS category

A.Dear Client,
The Jammu and Kashmir Government provides 10% reservation for residents of backward areas (RBA) in the State. Whereas, the EWS reservation is provided for the people of the General Category whose annual income is less than 8 lakhs per annum. Further, the J&K govt through an amendment to the J&K reservation rules,2005 stated that the people belonging to the RBA category are ineligible for the EWS certificate. Hence, in light of such an amendment, if you belong to the RBA category, then you will not be eligible for the EWS reservation.

A.Dear Client,
EWS is for those who belong to the General Category but whose annual income is less than 8 lakhs per annum. RBA belongs to the General Category who live in backward areas of the State of Kashmir. Office Memo No. 518 issued in Sept 2019, by the J&K govt brought a discriminatory amendment to the J&K reservation rules,2005, that held residents of backward areas (RBA category) as ineligible for getting the EWS certificate.it is discriminatory because; a resident of a backward area who has a BPL certificate can't take the benefit of a 10 percent reservation for the EWS category, whereas the same person can get the benefit of the EWS category if he Lives in a city of J&K. In view of the above, a candidate cannot avail of the benefit of both reservations available to the EWS & RBA categories.
