I have been married for two years but in these two years my husband has been abusing me verbally last year around april he slapped me for his neice just because i didn't wanted to give my 5 day old baby in his neice lap.on same night i called my parents and he misbehaved with them too for his brother s family.his brother kicked us out of his house. He constantly misbehaved with me for many days till i asked sorry for it.aftrwards we used to have small feuds but today our daughter got while i was washing clothes on her grandmother's watch. I tried telling him that he got angry and lashed at me and asked to leave the house i told him that he can leave if he wants than after some time he went out and came back and took all the money and his documents and ordered me not to touch them and now he's angry again and says that he won't pay for both of ours medical and other bills and also he is denying to give my parents money back which he took.

A.You can file Divorce Petition on the basis cruelty ground under section 13 of the Hindu Marriage. You can also initiate proceedings under domestic violence act to get direction from court to stop domestic violence. In any of the above proceedings you can claim maintenance during the court proceedings.

A.you didn't mention what do you want?

if you want to take any legal action againt your husband/in-laws, then,
you can file Domestic Violence case against your husband/in-laws for causing mental, social, economic and physical abuse,
you can claim maintenance for you and daughter as well
you can make a police complaint against husband/in-laws
but before taking any step
try to settle the matter amicably with your husband involving elders/relatives/friends

1) You can file a complaint under sec 498A in the nearest police station

2) You can file a complaint of domestic violence under sec 12 of pwdv act

3) Claim Maintenenace under sec 125crpc

4) In case you want divorce, you can file a divorce petition

A.Dear Madam,
You may go for DV case seeking following reliefs.

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent,
2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
3. Pass orders u/s 18, in totality against Respondent1 to 3,
4. Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.
5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited,
6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition.
7. The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,
8. That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.
