hello sir, can we file RTI to get the details of a owner of a flat which is situated in city Indore (M.P.)

A.Dear sir,
The provisions of Right to Information Act applies only to government and semi government organizations. You cannot get details of owner of a flat if it is private building. However you can get such details online or offline from concerned sub registrar in the Encumbrance Register

A.Dear Client,
The information you want to seek from a public authority under the RTI Act is known as Third Party Information which is defined under Section 11 of the RTI Act, 2005. As defined in clause (n) of Section 2 of the Act, 'third party' includes a public authority. Sub-Section (1) of Section 11 of the Act, states that where a Central Public Information Officer or a State Public Information Officer, as the case may be, intends to disclose any information or record, or part thereof on a request made under this Act, which relates to or has been supplied by a third party and has been treated as confidential by that third party, the Central Public Information Officer or State Public Information Officer, as the case may be, shall, within five days from the receipt of the request, give a written notice to such third party of the request and of the fact that the Central Public Information Officer or State Public Information Officer, as the case may be, intends to disclose the information or record, or part thereof, and invite the third party to make a submission in writing or orally, regarding whether the information should be disclosed, and such submission of the third party shall be kept in view while taking a decision about disclosure of information, Provided that except in the case of trade or commercial secrets protected by law, disclosure may be allowed if the public interest in disclosure outweighs in importance any possible harm or injury to the interests of such third party. The PI0 cannot disclose such information in response to an application made under Sec.6(1) of the Act unless the procedure prescribed under Sub-Section (1) to (4) of Section 11 is completed. Details of title or ownership of any property are kept by the office of the Sub-Registrar and the Land Revenue Office and both are public authorities and State Public Information Officers as defined under Sec.2(h) of the RTI Act, 2005. You can file an application under Sec.6(1) of the RTI Act attaching therewith application fees of Rs.10/-payable through the Indian Postal Orders to the SPIO seeking the information, But the disclosure of said information solely depends on compliance with the provision of Sec.11 and Sec. 8 & 9 of the Act.
