Prior to partition, that property was self acquired property of your grandfather so as per definition of ancestral property supported by Supreme Court reference, it was never an ancestral property prior to Partition and. therefore, your elder brother has no legal right to claim it as his ancestral. You have all the rights in the property, however, please provide all the legal documents of the property including gift deed.

There seems to be something wrong here. If the court order says that the land is to be partitioned and given to the parties then how come the revenue department record the land to somebody's else's name.
You need to give representation to the department for correction as per the court order and if they don't do then file case in the court.

There is no such limitation that might deprive you of having a direction or a decree of the court, in the said matter.
You may go for the High Court. Generally, in service matters, interim reliefs are granted, so there is a possibility that the court might not even refer to the CMD enquriy. You can just rely on the previous enquiry reports and stress upon the same, while arguing.

Whenever you buy a land or property then along with the sale deed or conveyance deed there must be a map showing the demarcation of the property. If that is mentioned in your deed then you can ask the seller to handover the same possession else you will have to go to court to resolve this.
