It is a settled principle of law that the owner has to pay the maintenance charges whether the flat is occupied or vacant, if the bye-laws of your society require you to pay them. Society can impose a reasonable penalty if they have made a rule to that effect. First try to collect video recordings of such leakage and then approach expert engineers and get expert Civil report on the quality of building constructions and in the report let the expert make it clear as to whether it can be repaired if so at what cost. Then approach Civil Court or Consumer Court to get compensation.
