It is very much important that the petition for divorce can be file after the complition of one year of the marriage on the grounds specified in the hindu marriage act. You must have strong ground to claim divorce and any way it will takes years together. It is better go for mutual divorce without alimony which may be acceptable to both of you.

2. As long as your brother co-operating with investigation agencies there should not be any problem in flying back japan.
