Wife forcing to withdraw Annulment petition to sign for Mutual Divorce
3 years ago
I applied for Annulment of marriage as wife was not cooperating for mutual consent, now she says that she will sign mutual divorce only if I withdraw my annulment petition. I don't trust her, what should I do?
Can I keep my annulment petition and file another petition for mutual divorce? How can I manage both petitions?

A.Dear Client,
You can either process annulment petition or mutual divorce petition, no two petitions are entertained at the same time, so withdraw any one of them

A.Hi,
You cannot file for both mutual consent divorce and annulment, as the Court can reject one if it become aware of the fact that the other has been filed. If your wife has agreed to consent to the divorce, you may withdraw the annulment petition.
However, you should let her know that annulment proceedings are often simpler and do not carry the same stigma as divorce.

A.Dear client,
If she is forcing for Mutual Divorce, the no issue. Tell her to appear before court on notice or on date before court and both of you would plea for Filing of Mutual divorce, Or convert the same petition into Mutual Divorce but only on
affidavit to do so, or as court directs to do so for the same.
Bech it totally depend on court acceptance of your request by ur advocate. There would not need of hr side advocate for Mutual.
Thanks
