A. Dear client,

It can be used in the court in a manner beneficial to the respondent, but the case cannot be won solely based on this alone; there needs to be other evidence to support the respondent's case as well.

A. Dear client,
The Indian Penal Code section 494 states that if a person commits second marriage without divorce or a crime similar to its section, then they can be imprisoned for seven years or more, depending on the crime. A fine is also charged in some cases, or both are charged together, which depends on crime severity.
NOC by wife for second marriage of husband is not recognized under law. It is of no use. A case can be filed even after NOC.

A. Dear Sir,
You have to contact advocate from Goa who is well acquainted with local laws. Generally when legal divorce is awarded by any Civil Court then the spouse has to wait for 90 days from the date of judgment to get to remarried.

A. Dear Sir,
The history of the case is required. Normally, in mutual divorce cases there is no question of hearing the parties since there is nothing to hear when both the parties agreeing to terms therein had signed the documents and submitted mutual divorce papers. If there is any fraud played by other side then such mutual divorce decree may be challenged before the High Court.

A. Dear Sir,
History of the case and documents are required. Normally, such right can be exercised by the wife within a reasonable time. Thus, complaint may be treated as time barred and after thought because such complaint was lodged only after receipt of your legal notice. If you go to High Court challenging such FIR it may be quashed.

A. Dear client,

Divorce by mutual consent can be obtained within six months, but no petition in such a case can be filed within first year of marriage. There also has to be gap of six months between the first and second motions. The court can waive this cooling off period in some cases.

You can file the petition for divorce only after the one year mark.
