Divorce petition under mutual consent
The mutual consent divorce petition is filed by My Advocate in the family court. The hearing date is fixed only on June 30th 2023. My husband married another woman in before the hearing date without getting divorce. How can proceed the case? Will he be punished?
My husband influenced my advocate and & I have no money to pay the fee. So I would like to proceed the case myself ( vakalath) without any advocate.
Is it possible for me? Should I get NOC ?
Kindly let me know is this possible ?
A.Dear client,
The Indian Penal Code section 494 states that if a person commits second marriage without divorce or a crime similar to its section, then they can be imprisoned for seven years or more, depending on the crime. A fine is also charged in some cases, or both are charged together, which depends on crime severity.
NOC by wife for second marriage of husband is not recognized under law. It is of no use. A case can be filed even after NOC.
