A. Dear Client,
In the absence of a Completion Certificate(CC) and Occupancy Certificate(OC) issued by the Civic Authority who approved the building plan on the application of the Builder/Developer, they are incompetent to execute a Deed of conveyance and cannot deliver the possession of the flat to the Buyer/Purchaser such a practice is defined as “unfair contract” u/s.2(46) of CPA, 2019. Moreover, both CC and OC is also defined u/s.2(q) and 2(zf) of the Real Estate(R & D) Act, 2016 cast ...ReadMore

A. Dear Client,
If the Cooperative Society is not cooperating or responding to your written appeal, you may bring the matter to the notice of the Regulatory Authority i.e, Registrar of Cooperative Societies for redressal of your grievance against the Society. Being a member of society, you got the right to acquire all these documents/papers from the society and the society is duty-bound to hand over the said documents as per the provision of the Byelaws of the society.

A. Dear Client,
Both WILL and POA is revocable by the Testator and Executor at any point of time as long as the party is alive. A Will is effective after the death of the Testator, but POA is invalid on the death of the Executor. So the status and the feasibility of the assurance remain the same in both documents. Instead, you may opt for a family settlement deed protecting your interest and assurance which will be signed by all the family members as a token of acceptance, and get the document reg ...ReadMore

A. Dear Client,
Section 42 (SC, ST Act) prohibits the sale of SC/ST land without approval in the State of Karnataka. This law was enacted to protect the interests of the SC/ST tribe. However, you can acquire SC/ST land by obtaining authorization from the DM or the collector. A general category person can't buy land belonging to SC / ST category through direct purchase. He has to take permission from the relevant authority(DM/Collector) for buying such lands. Properties that one acquires by way of a ...ReadMore

A. Dear Client,
Rooftops come under the purview of a common area in a housing complex and the residents can use that common area. As regard objection against the use by pets of any residents, the matter may be brought to the notice of RWA for a resolution in the matter. But in the absence of any provision as such in the Byelaws of the Association, the matter may not be resolved at that level. In that situation, you may make a mass application on behalf of residents having pets in the housing compl ...ReadMore

A. Dear client,
Since the RERA was adopted in 2016, it has generally been believed that MOFA laws continue to apply and that RERA only takes precedence in instances of inconsistency. Therefore, in the current scenario, when the discrepancy between the contents of the Sale Deed executed during 2018–19 and in 2020 in accordance with the RERA guidelines, appears on the face of the record, you may approach the RERA for necessary clarification and for an order for revision in the Schedule of the flat ...ReadMore

A. Dear Client,
The Building Plan for a housing complex includes the construction of car parking slots is approved by the concerned Civic Authority and Municipal Authority. The RERA got no role to play in the approval of the building plan. Registration of any housing project under RERA requires a sanctioned/approved building plan apart from other statutory documents. In case of any deviation in the building plan that approves for 9 car parking slots, then the construction of 15 parking slots instea ...ReadMore
