Hi Sir/madam, I am Santhoshini , My father(owner of property) wanted to hike the property (40 laks)after taking 1 lakh of advance taken by my brother, now my brother expired, Is it possible ? Shall my father can do it , that property rate actually is 50 lak .plz provide me answer , Tq.

A.Hi Santhoshini,


I strongly suggest sharing the sale agreement to find out the clauses/ suitable clauses before we make a solid opinion.

However, legally speaking we are binding on the clauses of the agreement and dispute on the payment of booking/advance amount needs to analyze as per the practicality.

A.Dear Madam,
He is bound by the agreement and you have to get issue a legal notice to the legal heirs of your brother that is your father and legal heir of your brother and then file suit for specific performance. Then you will get order/decree in your favor for the same sale amount as agreed in the agreement.
