property is on my mother name. She is alive .I need to transfer that house from her name to my daughters name. However, I am not sure and have the following questions
We are 3 brothers n 3 sister..my sisters are married and my one brother is not alive and one brother is handicapped..he lives with us...and I am third one..I m married I have two daughters. , Do I need any signatures and approvals from my sisters and their children to transfer that property to my daughter name
If my mother makes a will that the property belong my daughter after her death..then there is need of any signature of anyone or is there any chance my sister cased on

A.1. if the property is self-acquired by your mother, she can give the same to your daughter by way of transfer/gift,

A.Hi,

If the property is self-earned and your daughter is major, then you may follow the below:-

A. Request to discuss with all the family members and settle before you take any steps.
B. The gift will be the best options in this kind of cases,
C Meet with a lawyer, make a gift deed and fix a day for registration at jurisdictional sub-registrar office.
D. All your siblings shall put forward their signature as consenting witnesses and children will be simple witnesses. (if any minor, the same may represent by the mother).
E. Avoid making WILL as the same may raise lots of disputes in probate.

A.Dear Sir,
It seems the property belongs to your father and after his death it was transferred in the name of your mother. If so you cannot get property in the name of your daughter without the consent your married sisters and brother. Will if executed it can be challenged. Better now itself take NOCs and get gift deed from your mother in the name of your daughter and immediately change in the name of your daughter. Even without NOCs you can manage and later take loan on such property and make it complicated so that your sisters cannot claim the same. More suggestions in discussions.
