My friend(male) had sexting with one his cousin(female). she is married and also has a kid. Before marriage both had sexual intercourse with consent but broke up with some issues. Now her husband has used some whats app hacking tool and recovered entire chat and he is now threatening her that if she doesn't give mutual divorce he will release her private images online he even sent that chat to some of her family members.
Is my friend(male) is in trouble if a case is filed against him by her husband ?( everything happened between my male friend and his cousin(female) is with consent he did not force her or harass her)

A.First and foremost, the marriage of the cousin (female) of your friend is for all practical purposes over and dead. Secondly, if he is threatening her by releasing her private images online, then you can definitely advise her to take legal action viz. instead filing an application for maintenance for herself and her son and also a police complaint specifically mentioning that some doctored images and transcripts are being used by her husband to blackmail her into accepting divorce by mutual consent, which you are not interested in giving. Simultaneously file a complaint under Domestic Violence Act before the concerned court and get a residence protection order because the immediate next move by her husband would be to forcibly throw her out of the house. Well protected and shielded with these legal moves, she will have to decide terms on which to ultimately seek divorce, as I said marriage is wrecked. And do not easily get drawn into false hopes of settlement without the same being put in writing (without of course admitting to any relationship as being made out by her husband from the images and chats) as he may use the same to get her admission and then again ditch her.

A.Hi,

First of all, the instances mentioned to have happened are sensitive and needs to be dealt with in a careful manner. For issues such as these, online advices are not suitable. The best person to provide all information would be your friend. Hence, it is advised that, let your friend approach a lawyer and discuss the issues in detail.

A.Hi Rakshith,

We really need to discuss in detail to understand the depth of the concern and kind of chat/s. Was it before marriage or after, etc.

However, ask her to not come to a conclusion until you discuss in brief with a lawyer. If the SMS were exchanged before marriage, that should not hamper their relationship.

Hope No video available. we have dealt with similar cases.
