my cousin brother married and they have kid , from starting year they fight each other nd recently applied for diverse, she want diverse but my brother not accepting and also not giving money for maintanace, and her family members poor and not giving support her , she tried sucide attempt, later I take her to my house nd now living with me , now brother black mailing to file a case against me , how can I protect my self .
A.I have gone through your query in detail.
1) It is your cousin brother you said & also has a child of 1.5years & as they both are fighting everytime & she wants Divorce. But he is not giving Divorce & any money right so she is staying with you , so nothing is wrong. If you could not give her shelter then somebody else would have given her shelter.
2) As you said she comes from a poor background & doesnot have money, so has she applied for Divorce. She can get one sided divorce & she can also file for Divorce & Maintenance. Approach to some Mahila mandal or me so that we can give the deprived women her rights.
3) As she is staying with you, your brother on the other hand should be oblidged to you, as you have given shelter to her. And also being an adult she has her right to stay anywhere as per her choice
4) About your brother, he cannot put up a case on you as you are just providing a shelter to deprived women. So nothing to worry. But do give her legal rights to her & get her help to get the divorce. The Husband cannot force his wife to come to his house, if the women does not want to go to the matrimonial house due to physical violence.
