Can schools refuse to give back confiscated property

My son's school confiscated his phone. It is a cbse school and brought the phone for working a projector for science fair. As prior permission was not taken they confiscated the phone and refuse to hand it over to even us, the parents. The phone will only be returned when the ward leaves the school and takes TC. Which could be years. Does the school have the right to retain my phone for such long periods?

A.dear client school authority can not keep it . They have authority to impose fine you for this act. Issue an legal notice

A.You have to approach the management with all the true facts and circumstances involving other colleagues, friends and teachers involved with the help of all these with fair & just you can approach for solving the issue.If need you should ready to undertake the requirement of management.

It is foolish to say that they will return on student leaves school. You are under fix. If you lodge complaint with Educational Authorities then your ward will be given trouble. Be wise and nice to take return of mobile phone.

A.Absolutely not. They must return the phone to the parents and may take any disciplinary action if they want depending on their by laws or rules. Please ask them that under which rule or laws they have confiscated and will not return. If they behave in arbitrary manner then you may send them a notice.
