one lady in the name of government job, cheated me taken 10 lakh rupees, 1 year back i have had filled FIR, she got arrested, police has filed 420 case and submitted charge sheet in court, i have 10 lakh rupees bounche cheque of her, i am waiting for court to start, i wanted to file recovery suite, her son is involved in hiding money

A.420 case is not bar for recovery suit.

A.You can directly file a cheque bounce case along with the recovery suit that you wish to file and can every attach their properties either through criminal or civil proceedings if the non payment of the amount still exists along with a cheating complaint in the police station separately if you wish for

As the cheque is time barred, you cant file a case under NI Act, but you can file implead petition in the same police case under Section 420 IPC, as 420 IPC is a compoundable offence, the court may settle the charges if she is ready to pay back your 10 Lakhs.
