Father's Two separate houses after his death

My self and my brother with agreement of mother mutually make settlement of each house can take by one son without any dispute, file case in Lucknow Civil court, all three member given concern of no objection, but court reject and advise to go to Registrar office for Registry , now on what basis review petition file in District Judge court being in past such mutual partition judgement given by same court to other party, please suggest any Case study of past judgement or under which Section we can challenge the Judgement of rejection
