We have small piece of land in our native which is in tamilnadu, Thiruvanamalai near to vandavasi taluk. My dad and his brother are the true heirs. My grandparents were staying there but after their death the site was not used, the small portion of the site small House which was built in mud, was removed by my uncles who are staying just besides our site. Since they are our blood relative, we took it lightly and they were good to us as long as we gave then the rights to perform agriculture and earn from our land, once we came to know they were cheating and planning to take our land, we decided to revoke everything. My Dad is a retired central government employee who got settled in bangalore, now he wants to build a small house in the site so that we we can take care of our agricultural land. Since we were not much active in our native, we used to go yearly 3 times or 4 just to visit our relatives and have a look. In the meantime my uncle who are staying besides our site, put up a small shed in one corner of the site. My dad ignored this initially as we thought our relatives were very cooperative and will vacate when we requests them. But now when we are requesting they turned against us and not allowing us to posses the site and build house. Initially the land owners name was in my grandparents name. Since my uncle went to police station and compliant that we are demolishing their shed and trying to acquire their land, police people asked to convert the land site name to my dad and his brother, so that you will have full rights to do what ever we want. My dad went and converted the ownership rights to his name.After this we called the land surveyor to measure our land and they measured and approved it, also we got the signed copy from thasildhar. After all this we went to police station and told we have all the documents, and requested them to come along with us and help to remove the shed. But they said us to go and build the compound. But when we went and tried to build compound, my uncle and his sons and few people came and fought with my dad. Since my dad was alone with 3 workers, they insulted physically, my dad fought back and pushed my uncle and uncle fell down and had head injured. We are not sure when we have all the documents and rights correctly, still police is not helping correctly and not we are being targeted and threatened that we have hurt them and they are now completely not allowing to enter our land. We want to know what right kind of approach is needed to solve and we want to build our own house there and look after our agricultural land. Please help...

A.Hi,
According to the facts, you can file a case against your uncle, but, an an immediate action, you can send them a legal notice.

A.Hello,
As an instant action you may send your uncle a legal notice, and further you can file a case against them.
