I married 3 year before.due to some misunderstanding as well she not ready to take my mother.for this she simply left my home and went to her home.her mother and brother more supporting also they are so rich.currently thy blackmail me to complaint a dowry case and etc..we have 2 year girl baby..I need my baby also I am not so rich..need help as well divorce.she not ready to give divorce as well not ready to come my home.

If you do not want divorce, you can file a suit for restitution of conjugal rights.
However, if you want divorce, you can file a suit for divorce under mental cruelty as a ground for divorce.
You can file a case of divorce stating mental cruelty as a ground for divorce.

Your case is little bit complicated. If she is not ready to give divorce, then u can move for and file Divorce in Family court. But, you will have to give alimony to ur wife along with ur child care expenses, which may be fixed by court to pay per month, until the case going on or even after maintenance to her if not get married again.
There may be child custody issue.
If you can bear all ,then go for filing divorce. Also , in revenge, she may file 498A , Dowry and Domestic violence case on you.

According to the facts, you can send a legal notice and than you may file a case for divorce and for the custody of your child.

You may file a case for divorce and for the custody of your girl child. Also, if you wish you can at first send them a legal notice.
