My father passed away intestate. The house that my parents lived in is now occupied by my brother and he is daily threatening and abusing my mother when asked to vacate and go live with his family. He is locking away parts of the house with my mother's belongings inside. what legal options are available to my mother. The property distribution has not happened yet. My brother has a right in the property but does it allow him to occupy rooms in which my parents lived before my father passed away and what legal course can be taken against such abuse.

A.Hello,
Your mother may approach the nearest police station and register a complain, also she must file a suit against your brother.

A.Hi,
At first your mother should approach the nearest Police station and lodge complain and than she should file a partition suit against your brother

A.There is many remides with ur mother and other legal heirs. U can file partition suit, suit for possession and declaration, ur mother also file police complaint against her son for harrassment etc

A.Your mother can file case against your brother under DV Act.
