I and my husband together invested and built 2 single bhk houses on first floor of my in-laws property after he agreed and permitted us to build in March 2002. Our in-laws were staying in ground floor. Of the two houses built by us on first floor, one occupied by us another rented out. As the property was not registered in our name the rental agreement was in my father-in-laws name and rent was taken by him. We too kept quiet as my husband was the only son whose duty was to take care of his parents. After almost 10 years we asked our in-laws to get the tenant vacated on the first floor as our son has grown up and needs a separate room. But my father in law refused to do so and after my mother in law passed away in 2016 he got the house vacated and wanted to give the key of the house on first floor built by us, but his daughters started asking share and my father-in-law refused to give the keys and started saying that he needs rent for his living. Then my husband agreed to give Rs.8000 every month to him so that he can give the keys. Then my father in law started asking for money to give to his 2 daughters and never gave the house keys of the second house on first floor, built by us. And the house was vacant, locked bur money of Rs.8000/- taken from us every month. But he went on taking Rs.8000 every month until his death in Sept 2020 and never registered the first floor property in our name. We have proof of transferring money to his account from our bank accounts. During my father-in-laws sickness the daughters were staying with him in ground floor and just after his death the property papers by one daughter and another daughter has occupied the ground floor. All we want to know what is our right for the two houses built by us on first floor and not fully utilized by us and the income also given to our in-laws?

A.Hi,
The distribution of property will depend upon the fact whether the property is ancestral or self- acquired property.
However, if the property is ancestral property, then the property will be distributed among all the legal heirs.

More information is required regarding the facts of the case as to whether the property is self-acquired property or not.

A.you have the rights on both houses built. also you have 1/3 share in ground floor house.
you not took possession of other house ?
the land was brought by father-in-law or parental property ?
check if there is 'WILL" or daughters might produce fake "WILL"
