Hello, there is a flat on my brother and mother's name. now for last 3 months he has not paid any emi for the same because of some property dispute. so i wanted to know is there way so that we can remove his name and make my name as owner for the same and my bank account for the monthly EMI. he's to ready for the surrender of the property share.

A.Hi,
The bank can issue notice to him if he continue to default EMI. With his consent only can you transfer the property to yourself via gift or sale deed.

A.Hi,
The flat can be transferred under your name, but only with the consent of your brother. You can issue notice to him if he continue to default EMI.

A.emi and flat name are 2 different things.
emi is with bank, flat name at registrar.
it is possible, he can do gift deed and give noc.
