If i take original documents while taking mortgage, then , later the borrower goes to the registry office & says that he lost the orginal document & gets new original documents from registry office& sells that property & cheat me ? What to do ? How to prevent this ? What & how to do so that i'll not get cheated ?

A.Dear Sir,
It is all based upon faith many a times mortgage details not found in EC Register.

A.Hi,
You can file a suit for declaration of title and then present your original documents along with the mortgage deed to the Court as proof of ownership. Doing this will allow the court to grant a stay order on any fraudulent sale that the mortgagor might try to engage in.

A.Hi,
