Hi,
My Father in law owns a property of say 1.5 crore and wants to divide among elder and younger daughter

He says he borrowed 13 Lakhs from the elder daughter in 2010 and cannot repay now
He says the interest would have accumulated and now it is 30 Lakhs. These things he is saying now
so he wants to divide the property such a way that 105 lakhs to elder daughter and 45 lakhs to younger daughter my wife
Is this legal? The above is the main point that he is telling that liability can be taken from his property value.

Please can someone advise on this?

There are other things like he spent some money say 2 lakhs on my wifes former divorce expenses, he made my wife study for Mtech but free seat.


What does the law says on this?

A.If the property is self acquired, he has complete right to divide the property according to his will. He can gift 1/3 portion to his elder daughter and rest to his younger daughter during his life time.

A.Hi,
The father can divide the property as per his will given that this property is self earned and not ancestral. Incase of the latter, the daughters will get equal share.

A.Hi,
If the property is ancestral then both the daughters will have equal share. If it is his self earned property, then he can divide it however he wants.
